Terms & Conditions

Last updated: 20 April 2025  ·  Effective date: 20 April 2025

1. Definitions

In these Terms and Conditions:

2. Acceptance of Terms

By submitting an enquiry through our website, enrolling in a programme, or accessing any programme materials, you confirm that you have read and agree to these Terms and Conditions.

Our programmes are intended for individuals aged 18 or older. By enrolling, you confirm that you meet this age requirement and have the legal capacity to enter into a binding agreement under the laws of Thailand.

3. Programme Description and Availability

Lotus Studio offers three online programmes delivered asynchronously, with optional support from instructors and mentors. Descriptions of each programme — including prerequisites, scope, and expected duration — are provided on the programme pages of our website. We make reasonable efforts to keep those descriptions accurate and up to date.

Access to programme materials is provided online. We make reasonable efforts to maintain platform availability but do not warrant uninterrupted access. In the event of significant disruption, we will notify enrolled learners and, where appropriate, extend access periods.

Programmes are available to learners worldwide, though our primary operations and support are based in Bangkok, Thailand (ICT, UTC+7).

4. Enrolment and Account

Enrolment in a programme begins when you have submitted payment and received confirmation from us. You are responsible for maintaining the confidentiality of your login credentials and for any activity carried out under your account. Please notify us promptly at [email protected] if you believe your account has been accessed without authorisation.

Programme access is granted to one individual learner. You may not share your access credentials with another person or allow others to use your account to access programme materials.

5. Learner Responsibilities

When using our platform and engaging with programme content, you agree to:

6. Intellectual Property

All programme content — including written materials, exercises, explanations, and recordings — is owned by Lotus Studio or its instructors and is protected by applicable copyright law. We grant you a limited, non-exclusive, non-transferable licence to access and use the content for your personal learning during the period of your programme access.

You may not copy, reproduce, distribute, publish, sell, or create derivative works from any programme content without our prior written consent. This restriction does not limit your right to make personal notes, apply what you have learned in your own work, or discuss programme concepts in academic or professional contexts.

Any original research work developed by you during the AI Research Pathway remains your intellectual property. Lotus Studio does not claim any rights over such work.

7. Payment Terms

Programme fees are listed in Thai Baht (฿) and are payable in full at the time of enrolment. Current fees are:

Payment is accepted by bank transfer for learners in Thailand. Learners outside Thailand should contact us to discuss available arrangements. We do not store card details; payment processing is handled by a third-party provider.

Refund policy: If you notify us in writing within 7 days of enrolment and before accessing more than the first module of a programme, we will issue a full refund. After that point, fees are non-refundable except where we are unable to provide access to the programme as described. Refund requests should be sent to [email protected].

8. Programme-Specific Terms

All programmes: Access to materials is provided for a minimum of 12 months from the date of enrolment. If you require additional time, please contact us and we will discuss a reasonable extension.

Instructor support: All programmes include access to instructor support for questions arising from the programme content. We aim to respond to questions within two working days during Bangkok office hours. Support does not include assistance with work unrelated to the programme.

AI Research Pathway — mentorship sessions: Mentorship sessions are scheduled by mutual agreement. We will make reasonable efforts to accommodate your schedule. If a session needs to be rescheduled, please provide at least 24 hours' notice where possible.

Certificates: We do not issue formal certificates of completion. Learners who complete a programme may request a written confirmation of completion, which we will provide upon request.

Academic integrity: Work submitted for feedback or discussion in the context of a programme should represent your own understanding. We reserve the right to withdraw programme access if we determine that a learner is engaged in systematic misrepresentation of their work.

9. Disclaimers

Our programmes are designed to support learning and skill development. We make no representation that completing a programme will result in employment, admission to a graduate programme, acceptance of a research submission, or any other specific outcome. What learners are able to do as a result of a programme depends on factors including their prior knowledge, the effort they invest, and their goals.

Programme content reflects the state of the field at the time of last review. We make reasonable efforts to keep content current but cannot warrant that all content remains accurate given the pace of development in AI.

Our website and programme platform are provided on an "as available" basis. We do not warrant that they will be free from errors, interruptions, or security vulnerabilities, though we take reasonable steps to maintain quality and security.

10. Limitation of Liability

To the extent permitted by Thai law, Lotus Studio's total liability to you for any claim arising out of or relating to your use of our programmes or website shall not exceed the fee paid by you for the relevant programme.

We are not liable for indirect, incidental, or consequential losses, including loss of income, opportunity, or data, even if we have been advised of the possibility of such losses.

Nothing in these terms limits liability for death or personal injury caused by our negligence, or for fraud or any other matter that cannot be excluded under applicable Thai law.

11. Indemnification

You agree to indemnify and hold Lotus Studio, its instructors, and staff harmless from any claims, losses, or expenses (including reasonable legal fees) arising from your breach of these Terms, your misuse of programme materials, or your violation of any applicable law in connection with your use of our services.

12. Termination

We may suspend or terminate your programme access if you materially breach these Terms and fail to remedy the breach within 7 days of written notice. Grounds for termination include sharing access credentials, distributing programme content without permission, or conduct that disrupts the learning environment for others.

You may terminate your enrolment at any time by notifying us in writing. Refunds are subject to the policy set out in Section 7. Sections 6, 9, 10, 11, and 13 survive termination.

13. Dispute Resolution and Governing Law

These Terms are governed by the laws of the Kingdom of Thailand. Any dispute arising under or in connection with these Terms shall first be addressed through good-faith discussion between you and Lotus Studio. If a dispute cannot be resolved informally within 30 days, it shall be referred to the competent courts of Bangkok, Thailand.

If you are a consumer resident in a jurisdiction with mandatory consumer protection laws that provide broader rights than those described here, those rights are not affected by these Terms.

14. General Provisions

Entire agreement: These Terms, together with any programme-specific communications provided at the time of enrolment, constitute the entire agreement between you and Lotus Studio regarding our programmes.

Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions continue in full effect.

Waiver: Our failure to enforce any provision of these Terms on a particular occasion does not constitute a waiver of that provision.

Assignment: You may not assign your rights under these Terms to another person. We may transfer our obligations to a successor in the event of a change of ownership of the business.

Notices: Communications from us will be sent to the email address you provided at enrolment. Notices to us should be sent to [email protected].

15. Changes to These Terms

We may update these Terms from time to time. When we do, we will update the "Last updated" date at the top of this page. We will notify enrolled learners of material changes by email at least 14 days before they take effect. Continued use of our programmes after a change takes effect constitutes acceptance of the updated Terms.
